For EVAL it is of utmost importance to guarantee the privacy and security of the information provided by USERS to the eval.digital Site (“SITE“). All registered data shared with us are stored securely and are not sold, ceded, exchanged, or divulged to third parties without express authorization from our USERS.

• It is the responsibility of the USER of the SITE to correctly provide his personal data and to guarantee that it is true.
• A EVAL constantly seeks to improve its tools and technology to provide total data security to its customers. USERS, making use of the most modern and efficient security practices, in the development and hosting of its virtual platform, assuring its USERS, since it prevents the loss, misuse, alteration or unauthorized access to the personal data provided

• Our Privacy Policy also demonstrates our commitment to protecting the privacy and data of our USERS while using our SITE. Use of the SITE is governed by this Privacy Policy. By using, accessing or participating here, you agree to our Privacy Policy.
• Personal Information: When you access our SITE and register, we require that you submit certain information that personally identifies you, which may include your first name, last name, e-mail address and other information (collectively, “PERSONAL INFORMATION“). There will be no unauthorized access, improper use, or alteration of the data provided, because these data will be kept in total security. EVAL is committed to using your Personal Information with care and caution.
• EVAL ‘s knowledge about the Users’ Information is important and necessary to the proper operation of the SITE, since it allows EVAL to know the USERS and, thus, to promote an environment that is compatible with their interests and allows them to fully enjoy the facilities of the SITE. On the other hand, this knowledge is indispensable to the security of the SITE, of the parties that relate to it and, above all, to the security of the transactions that are carried out through it.
• The Users’ Information concerning the use they make of the SITE and the way they behave will not be published by EVAL, nor shared with third parties, serving only so that EVAL has the means to keep the SITE always compatible with the interests of its USERS.
• Responsibility for Confidentiality: You will be responsible for ensuring the confidentiality of the Personal Information that you submit to EVAL. Inaccurate information will affect your use of the SITE and other features, as well as our ability to contact you, as described in this Privacy Policy. Thus, you will be responsible for the confidentiality and proper use of your log in and password, created at the time of registration.
• Disclosure of Information: EVAL does not share, sell, rent or trade your Personal Information with third parties for promotional purposes. We reserve the right, however, to disclose your Personal Information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process. Additionally, we inform you that we will only disclose our USERS ‘ data in an aggregated and disidentified manner, except when otherwise required by law.
• Security: The Personal Information we collect about you is stored on a secure, password-protected server and only authorized persons have access to it; in addition, we use technologies regarding the receipt and transfer of this information. However, despite our zeal, no transmission over the Internet or cellular network and no other method of data storage can be guaranteed to be secure 100% (one hundred percent) of the time. We work with partners, developers, and service providers in general. Eventually, such persons may have access to the data stored by us, however, this eventual access will be closely monitored and if there is any suspicion of illegal conduct, any applicable judicial and extrajudicial measures will be taken.
• Impersonal Information: To enhance your experience when using the SITE, we collect information other than Personal Information (“Impersonal Information”) about your use of the SITE.
• Cookies: We use “cookies” to personalize your experience with the SITE. We do not connect the information stored in cookies with any Personal Information about you.
• Data Traffic: We automatically track and collect the following categories of information when you visit our SITE: Internet Protocol (“IP”) addresses; (2) domain servers, (3) types of computers and/or mobile devices accessing the application. • Unsubscribing from Communications: If you no longer wish to receive communications from EVAL, you may opt-out by following the instructions included in each communication or by contacting us by e-mail at: [email protected].
• Transfer and Storage of Data: The EVAL platform is stored on servers in the cloud; by submitting your Personal Information, you agree to the transfer and storage of it and the use of it in accordance with the purposes for which it was collected.
• Use and Disclosure: A EVAL may also, as consented by USERS who adhere to this Policy, disclose any of the User Information to any other company that is or will be controlled by it, affiliated to it, or that is its parent company, as well as to its partners, administrators, employees and contractors that, for the performance of their functions, need to have knowledge of User Information.
• The same right of revelation contained in the head of this Clause is extended to the hypothesis that EVAL undergo any type of transaction involving the transfer of part or all of its assets, such as, but not limited to, merger, spin-off, or divestiture, in which case the User Information may be disclosed and transferred to the successor company of the EVAL.
• Liability: Despite the measures referred to in Clause 1.11, EVAL cannot guarantee that the Users’ Information is totally secure, in view of the influence of external agents or agents that are beyond EVAL‘s control, which may materialize, for example, in the following situations:

(i) Hacking that cannot be contained by the security measures normally used by EVAL;

(ii) Misuse of the SITE by USERS, or lack of care or good faith on their part, either with their own Information or with the Information of other USERS, including violation of the Clauses above; and,

(iii) Actions of other companies that, by their own activity, have access to some of the Users’ Information, such as companies that provide Internet access, e-mail services, and mobile telephony.

• The negligent or infringing USERS will be exclusively responsible for the losses and damages which result from their behavior, including towards EVAL and other USERS, if they are affected in any way.

3. Other Provisions

• Any questions or requests related to this SITE ‘s Privacy Policy should be sent to EVAL by e-mail to [email protected].
• The tolerance of the eventual non-fulfillment of any of the clauses and conditions of this Privacy Policy will not constitute novation of the obligations stipulated herein, nor will it hinder or inhibit their enforceability at any time by EVAL TECHNOLOGY.
• Changes to Privacy Policy: We reserve the right to change the Privacy Policy at any time, at our sole discretion. Upon any change in the Privacy Policy, the modified text will be published. In all cases, use of information that we collect is subject to the Privacy Policy in effect at the time the information is collected.
• The USER may manifest his/her opposition to alterations that occur in the Terms of Use and Privacy Policy, as long as they are made in writing, through the e-mail [email protected], which will generate the CANCELLATION of his/her registration.
• To resolve any doubts concerning this Privacy Policy, the laws of the Federative Republic of Brazil are hereby established, regardless of the country from which the SITE is accessed. Any disputes or legal controversies arising from acts practiced within the scope of these platforms by the USERS, including with regard to non-compliance with the Privacy Policy or violation of third party rights, will be processed in the district court of São Paulo/SP.
• The valid and effective version of this Privacy Policy is that currently posted on both platforms. This version governs all past and present relations between USERS. Therefore, the USER must always read the present Privacy Policy carefully, since he/she will not be able to avoid it by alleging ignorance of its terms, including with regard to eventual modifications.

O USER declares that he/she has read, understood, and accepts all the rules, conditions, and obligations established in the present Privacy Policy.
